Non-Profits in Ventura County Lose Tax-Exempt Status - Is Your Non-profit at Risk?
Nearly 600 non-profit organizations in Ventura County received notices this past summer from the IRS stating that their tax-exempt status had been revoked due to non-filing of tax returns for the last three consecutive years. Although these organizations do not have to pay taxes, they are still obligated to submit abbreviated informational returns. This action is part of the IRS' efforts to weed out defunct non-profit organizations, but unfortunately has affected legitimately active non-profits, who are now not allowed to receive tax-deductible donations, and whose income will be taxable until their exempt status is reinstated.

Erik B. Feingold selected as a finalist for the Consumer Attorneys of California Consumer Attorney of the Year Award

Jill L. Friedman Appointed to American Board of Trial Advocates
Jill L . Friedman, a Myers, Widders attorney, was recently named to the American Board of Trial Advocates (ABOTA). Attorneys must have tried a minimum of ten civil jury trials to be considered for membership.
Recognized for her proficiency as a trial lawyer, personal character and honorable reputation, Ms. Friedman is among a limited number of attorneys chosen for this invitation-only organization and is only the fifth female attorney in the Central Coast Chapter, which includes Ventura, Santa Barbara and San Luis Obispo Counties. As a member of the organization, she is committed to fostering improvement in the ethical and technical standards of practice in the field of advocacy to ensure that individual litigants receive more effective representation and to allow the public to benefit from more efficient administration of justice consistent with time-tested and traditional principles of litigation.
For more than 20 years, Ms. Friedman has been very successful in trying civil cases on behalf of both plaintiffs and defendants. At the beginning of her career, she tried cases as a visiting attorney with the Ventura County District Attorney’s Office. She later worked as an insurance defense attorney in Ventura before returning to her hometown of Santa Barbara, where she continued practicing in the field of insurance defense and medical malpractice defense. She then founded and practiced in her own law firm for eight years, representing injured plaintiffs. She next practiced for nine years with Henderson & Borgeson in Santa Barbara before returning to Ventura. In 2004, she co-chaired a trial that led to the California Supreme Court decision in Ramirez v. Nelson (2008) 44 Cal.4th 908 regarding homeowners’ liability for the wrongful death of an unlicensed, uninsured tree trimmer. Ms. Friedman is the current President of Women Lawyers of Ventura County.

Judgment Entered in Multi-Million Personal Injury Case Involving Former CHP Officer, Anthony Pedeferri
VENTURA – On March 10, a Ventura County Superior Judge entered Judgment on the special verdict in favor of the plaintiffs, Anthony Pedefferi and Carrie Pedefferi. The final Judgment is still subject to post-trial motions, which may include the award of costs and attorneys’ fees and attacks on the jury’s verdict.
Parties have 60 days from the notice of entry of judgment to file a Notice of Appeal. The court ordered a stay of the enforcement of the judgment until 10 days after the last day appeal can be taken.

MWGJS Wins Largest Personal Injury Case in Ventura County's History
On January 25, a Ventura jury awarded the largest personal injury verdict in the County’s history – nearly $50 million - arising out of a tragic vehicular accident. Jurors awarded former CHP Officer Anthony Pedeferri and his wife, Carrie, over $39 million in damages and awarded $10.2 million to Jesus and Dora Parra. The Parras’ son, Andres, was killed in the traffic accident on Highway 101, which also left Pedeferri a quadriplegic.
Erik Feingold, a partner with the Ventura based firm of Myers, Widders, Gibson, Jones & Schneider, and Beverly Hills attorney Michael Alder represented Tony Pedeferri, a former CHP officer and world class triathlete, and his wife, Carrie Pedeferri. The Parras’ were represented by Los Angeles attorney John Gerard.
Earlier this month, the jury found Jeremy White of Paso Robles negligent in causing the Dec. 19, 2007 accident near Faria Beach north of Ventura. In a separate criminal case, White was sentenced in 2008 to 15 years in prison for the crash. He pled guilty to two felonies: gross vehicular manslaughter while intoxicated and selling and transporting marijuana. The accident occurred when Pedeferri was either ticketing or assisting Parra on the shoulder of northbound Highway 101. The officer was standing besides Parra’s vehicle when White’s truck slammed into Parra’s sport utility vehicle, killing Parra and causing horrific injuries to officer Pedeferri.
The jurors also found Bert’s Mega Mall in Covina liable in the case. They found that mall employees did not properly strap down two dirt bikes in the back of White’s truck, causing a distraction and contributing to the crash. The jury attributed 67% of fault to White and 33% to Bert’s Mega Mall.
As a result of the jury's allocation of fault, Bert's Mega Mall will be liable for more than $22 million of the award to the Pedeferri’s (100% of over $13 million in economic damages and 33% of $26 million in non-economic damages) and more than $3.8 million to the Parras’ (100% of $675,000 in economic damages and 33% of $9.525 million in non-economic damages). Zurich Insurance, which insures Bert's Mega Mall, had an opportunity before trial to settle the Pedeferri’s entire case for $10.0 million, within its policy limits. Counsel for Bert's Mega Mall indicated his intention to appeal the verdict.
